5 MILLION RAND FINE FOR POPIA NON-COMPLIANCE

In terms of the Protection of Personal Information Act of 2013 (“the Act”), there are severe fines and/or imprisonment for non-compliance with the Act. For example, for minor offences a guilty party can receive a fine or be imprisoned for up to 12 months and for serious offences the period of imprisonment rises to a maximum of 10 years.  Administrative fines for a company can reach a maximum of R10 million.

Recently, The Information Regulator, the statutory body mandated to ensure compliance with the Act, fined the Department of Justice and Constitutional Development R5 million after it failed to comply with an enforcement notice.

If your company and/or legal entity is not compliant with the Act, a fine of the same if not similar amount may be fined against your company should it be found to not be compliant with the Act. At Tuckers, we have developed a POPIA product which can assist you in becoming compliant with the Act.
